Ask the child support pro’s… how do I collect the additional amounts that are ordered to be paid?

I came across your website and I’m wondering if you can help me.

My ex-husband is supposed to pay 50% of the extra expenses for the 2 kids.

Right from the start, he didn’t do that and I admit that I stopped recording the extra expenses, after 1.5 years as he was not responding. This is court ordered in our divorce degree. But how do I enforce it? That is my big question I don’t have the money to go back to the lawyer and do anything about it.

I have filled for child support and they assigned a monthly amount that should start taking effect shortly or by now I should have received the first payment.

I don’t think this voids the original order by the court that he still needs to pay for the 50% on the extra expenses.

Thank you for the email and questions. The extra expenses the “NCP” (non custodial parent) was to cover in the original order will be difficult to collect without accurate record keeping. Generally those expenses would need to be reduced to a judgment in order to know how much he is responsible for. Since you did not maintain a complete history, I don’t know how the judge would rule on this. As for if this part of the agreement is still in place after your modification, you would need to refer to the courts on that. The modification would be the new document used to enforce if there were changes made to the original order.

I suggest you take the documentation you have to the county child support enforcement office and discuss the best way to proceed. In the meantime, please start to record all extra expenses again, this is the only way to know what the actual expenses are.
